Fiduciary Quandaries in Discretionary Actions and Other Perplexing Problems in Trust Administration

Sponsored by J P Morgan Private Bank

What is included in a distribution for a beneficiary’s “health, education, maintenance and support?”  Does it include everything your client would expect?  This panel of three experienced fiduciary officers will discuss how discretionary distribution language of trust agreements is implemented, including the breadth of the common HEMS distribution standard  Further, the impact of other language, such as “other resources,” “standard of living” and “best interest” will be discussed.  What are the implications of drug clauses, mission statements and incentive clauses?  This will be a discussion of where the rubber meets the road on trust language and beneficiaries interests, illustrating that the language of the trust agreement counts, including drafting tips for greater clarity!  Debbie Cox (Moderator) is a Managing Director at J.P. Morgan Private Bank. Ms. Cox provides advice on wealth structuring solutions related to wealth transfer, family governance, business succession, philanthropy, and tax planning. Ms. Cox joined J.P. Morgan Private Bank’s Wealth Advisory group in 2002. She brings more than 30 years of wealth advisory experience to J.P. Morgan.  Julie A. Buschman joined Bessemer Trust in March 2005 as Senior Client Account Manager in Bessemer’s Dallas office.  Previously, Ms. Buschman was with the Dallas office of Bank of America, N.A. Her most recent position was Regional Estate Settlement Executive responsible for the creation and implementation of regionalized estate settlement services within the Private Bank.  Jacqueline Gabbidon is VP-Senior Trust Relationship Manager at Northern Trust.  She is a member of the Wealth Advisory Team providing fiduciary and investment management services to high net worth individuals and families.  Prior to Northern Trust, Jacqueline was an attorney with Klein & Pollack and Thompson Coe.  Sam Dykeman is a Vice President/Fiduciary Officer with the Private Bank of JPMorgan. He joined the company in May 2007. He has worked for several other large trust companies in Dallas.
