EXPLOITATION OF THE ELDERLY

Our expert speakers include: Molly D. Abshire, Partner, Wright Abshire; Donna Strittmatter, Chief, Specialized Crime Division, Dallas County District Attorney’s Office; and Dr. Mary Quiceno, Assistant Professor, Neurology & Neurotherapeutics, UT Southwestern Medical Center.  The three speakers will take turns presenting, touching on different areas of mental capacity. At a high level Molly is going to discuss the definition of capacity, the case law, presumptions regarding capacity, and briefly touch on professional duties. Dr. Quiceno will discuss the medical side of mental conditions, including how non-physicians might spot capacity issues. Donna will then go into the criminal side, including the criminal penalties for taking advantage of diminished capacity and use some criminal jury trials as examples.  Molly Dear Abshire received a J.D. from South Texas College of Law and her B.A. in English from Texas A&M University. She is Board Certified by the Texas Board of Legal Specialization in Estate Planning and Probate Law and is a Certified Elder Law Attorney, accredited by the National Elder Law Foundation.  Ms. Abshire has authored professional papers and Houston Chronicle articles, which typically focus on topics such as estate planning, Medicaid planning, elder law and special needs trusts. Dr Mary Ellen Quiceno is Assistant Professor of Neurology & Neurotherapeutics at the University of Texas Southwestern Medical Center, Director of the UTSW Cognitive & Memory Disorders Clinic, and Leader of the Outreach, Recruitment & Education Core of the NIA-Funded Alzheimer Disease Center at UTSW. She is certified by the American Board of Psychiatry & Neurology in Neurology and holds subspeciality certification by the United Council on Neurologic Subspecialties in Behavioral Neurology & Neuropsychiatry. Donna Strittmatter Max is an Assistant District Attorney with the Dallas County, Texas District Attorney’s Office.  She has been with the office for over 11 years and is currently the Chief of the Specialized Crime Division, a position she has held since 2009.  In her role, she has handled the intake of thousands of criminal prosecutions of fraud, often directing the investigation for law enforcement and victims.  Donna is involved in various regional task forces relating to health care fraud, consumer fraud, banking and economic computer crimes. 

There is continuing ed credit pending for this presentation.
